“I only had a couple of drinks.”

Acknowledging that you consumed any amount of alcohol is a grave mistake. Police officers are allowed to follow the “affected by” rule in the state of Washington. This means that your BAC can be less than 0.08 and you can still be charged with a DUI if the officer perceives impairment. Admitting that you were drinking gives them reason to scrutinize you more intensely and increases the likelihood of you being arrested.

“I’m fine to drive.”

This statement is a subtle admission of guilt. It implies that you may be questioning your own sobriety. The more you try to convince the officer, the worse it looks. Under the law, you should never get behind the wheel if you think you may be impaired. Suggesting that the officer could be doubtful about your condition gives them more of a reason to investigate.

“I know my rights!”

Arguing with officers won’t get you anywhere but jail. While it is true that you have rights, being combative can make it seem like you aren’t in a sound state of mind. Remain respectful throughout the traffic stop or checkpoint, follow instructions, and request an attorney if you are arrested.

“My friend’s a…”

Even if you do have a close relationship with a lawyer, judge, or police officer, name-dropping is not effective. No one is above the law, regardless of their connections.

“I’m not drunk!”

It is natural to want to advocate for your innocence, but the more you protest, the more guilty you may appear to the officer. Remember, you can still be arrested for a DUI if your BAC is under 0.08. If the officer thinks you are affected, they can still proceed with an arrest.

“I take prescription meds.”

The best thing you can do is remain calm and listen. If the officer asks for your license, registration, or other information, provide it.
